FAQ's

  • What is the legal limit of Alcohol for a DWI in the State of Texas?
The proportion of alcohol to blood in the body is expressed as the blood alcohol concentration (BAC). When your BAC level reaches .08 it becomes illegal to drive a motor vehicle in the State of Texas.

  • Can I just pay the fine? What can happen to me?
DWI Laws in the State of Texas are serious and fines can reach thousands of dollars with the possibility of incarceration and loss of your ability to operate a motor vehicle. In addition, you may incur court costs, probation & fees, community service, and other costs resulting from a DWI conviction. Since each case is unique and the type of defense we present depends on many factors, your initial free consultation will provide you with the facts you need to make an informed decision.. We offer several payment options that will allow you to take on this issue with confidence and integrity you deserve.

  • Will my drivers license automatically be suspended?
You have the right to a court hearing within 15 days of an arrest to appeal to the Texas Department of Public Safety to retain your right to drive. Our law firm will aggressively defend this right and file a request on your behalf to keep your driving privileges.

  • Do I take the Field Sobriety Test or the Breath Intoxilyzer Test? Can it be wrong?
Whether or not you take the breath intoxilyzer test or any field sobriety tests, does not dictate whether you will be convicted of a DWI.
That being said, calling an attorney before or after you take these tests should be your first priority and should not hurt your case. Because of our experience/training in legal testing procedures, maintenance and administration of these tests, I may be able to show inconsistencies that can arise.

  • Will I lose my Insurance?
You could lose your insurance depending on your carrier's policy, but we will file an immediate SR22 on your behalf to negotiate new coverage. Upon our initial consultation, we will provide you with information on insurance alternatives.

  • What is a Plea Bargain and can it help me?
The County prosecutor may offer probation and reduced fines and/or community service to circumvent and expedite court proceedings. However, as your attorney, I will use my years of experience, expert knowledge of DWI law and my conservative approach in this area to defend your freedom while maintaining your best interest. A single DWI conviction on your record can cause serious career repercussion, financial difficulties as well as your freedom. If a plea Bargain is negotiated, you can feel confident that your interest is my top priority.
